Motorola victorious in Apple ITC lawsuit

Motorola has emerged victorious from a legal skirmish with Apple as the US ITC ruled that Motorola did not infringe Apple’s patents.

Apple had alleged that Motorola’s Android smartphones infringed three Apple patents. A successful action could have seen Motorola devices banned from import into the US market.

"We are pleased with today’s favorable outcome for Motorola Mobility," said Motorola counsel Scott Offer. The ruling so far is preliminary so it still needs to be ratified.

Assuming the decision is upheld, the win builds on Motorola’s earlier success in a German court. The three patents which the ITC said Motorola did not infringe upon were part of the usual counter-sue operation following Motorola suing Apple over a raft of patents.

Apple co-founder Steve Jobs had vowed ‘thermonuclear war’ on Android, believing the OS to be to be ‘stolen’. It’s possible the win could cool Apple’s strategy of all out battle in the courts.
