Retailer claims to have acted in “the very best interests of its customers”

Comet responds to Microsoft lawsuit

Comet has issued a statement in response to the news that Microsoft is to take legal action over the production of counterfeit recovery discs.

A short entry at the Comet website notes that legal proceedings have been issued but interestingly does not deny the claims, instead stating that the retailer had acted in the best interests of its customers.

“Comet has sought and received legal advice from leading counsel to support its view that the production of recovery discs did not infringe Microsoft’s intellectual property,” reads the statement.

“Comet firmly believes that it acted in the very best interests of its customers. It believes its customers had been adversely affected by the decision to stop supplying recovery discs with each new Microsoft Operating System based computer. Accordingly Comet is satisfied that it has a good defence to the claim and will defend its position vigorously.”

Although it could be argued that Comet has the moral high ground on this one, unfortunately for them it’s probably not going to stand up in court.
