Apple monopoly claim dismissed A US federal judge has deemed that Apple products do not constitute a monopoly, contrary to claims made by Apple ‘cloner’ Psystar.

The ruling effectively puts an end to Psystar’s defence in its ongoing antitrust lawsuit. The firm was sued for breach of copyright after the firm started selling generic PCs with a pre-installed copy of Mac OSX and countersued, claiming that Apple’s practice of tying its operating system to Macintosh hardware was illegal.

The judge decided that Apple’s own products were not unique enough to be considered a separate market, therefore Apple could not be found guilty of monopolising its own products.

Psystar now has the chance to amend its suit and ask the judge to reconsider within 20 days.
